An Arizona man was arrested in Adel Saturday on charges of incest and third-degree sexual abuse.

Brett LeRoy Smith, 36, of Mohave County, Arizona, was arrested on a warrant for incest and third-degree sexual abuse.

According to court records, the Adel Police Department was contacted June 4, 2020, by the Dallas County office of the Iowa Department of Human Services about a report that a 15-year-old female in Adel gave birth to a female child May 12, 2020.

A genetic test performed by the University of Iowa Children’s Hospital determined that “the parents of the child were first-degree biological relatives,” according to court records.

The juvenile victim later told a social worker at Blank Children’s Hospital that Smith, her father, was the father of her child.

Smith’s daughter confirmed that Smith “had committed a sex act with her,” and she told the social worker that Smith was “upset that she had become pregnant and
yelled at her over the phone,” saying, “‘You know that could be my baby.'”

A criminal complaint was filed Aug. 19 by the Adel Police Department in Dallas County District Court, and a warrant for Smith’s arrest was ordered Aug. 20 and served Sept. 12.

Smith is held in the Dallas County Jail on a $501,000 cash-only bond. He is scheduled for a preliminary hearing Sept. 22 in Dallas County District Court.

*A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
