The incident began about 3:45 a.m. Wednesday in the 7600 block of Office Plaza Drive N. in West Des Moines, where officers of the West Des Moines Police Department were conducting an investigation at a motel.

According to court records, during the course of the investigation, Garner allegedly “physically resisted arrest” and caused “scrapes and cuts to” an officer’s “hands and knees, causing him pain.”

Garner was found not guilty of harassment of a public officer/employee at trial in 2011 in Polk County District Court.
