Perry man arrested for allegedly driving drunk, armed

Nicholas Andrew Wallace, 23, of Perry was arrested Tuesday on charges of first-offense OWI, possession of a dangerous weapon while under the influence (firearm) and driving under suspension.

A Perry man was arrested early Tuesday for drunk driving and going armed while drunk.

Nicholas Andrew Wallace, 23, of 2506 Perry Park Ave., Perry, was arrested on charges of first-offense OWI, possession or carrying of dangerous weapons while under the influence and driving under suspension.

The incident began about about 12:45 a.m. Tuesday in the 400 block of 16th Street, where an officer of the Perry Police Department attempted to initiate a traffic stop of a 2008 Chrysler Town and Country van.

The driver of the vehicle, Wallace, did not stop but “continued northbound, ignoring the emergency lights of the patrol car, and then turned westbound onto Perry Park Avenue,” according to court records.

The officer made contact with Wallace, who allegedly emitted “an odor of an alcoholic beverage” and presented “slurred speech and blood shot eyes,” according to court records.

“I’m drunk,” Wallace allegedly repeatedly told the officers.

A search of the vehicle disclosed “an open bottle of Fireball cinnamon-flavored whiskey” and a 9 millimeter Beretta handgun, containing a fully loaded 17-round magazine, according to court records.

Wallace was issued a summons to appear June 25 in the Dallas County District Court.

*A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
