A Dallas Center woman allegedly assaulted an officer of the Perry Police Department early Sunday after she was stopped in Perry for alleged drunk driving.

Emily Michelle Rodriguez, 39, of Dallas Center was charged with first-offense OWI, interference with official acts and assault on persons in certain occupations.

The incident began about 12:30 a.m. Sunday near the intersection of First Avenue and Park Street in Perry, where an officer of the Perry Police Department initiated a traffic stop on 2005 Toyota Camry that appeared to be operated erratically.

The officer made contact with the driver, Rodriguez, who allegedly presented with the “odor of an alcoholic beverage emanating from her person,” bloodshot, watery eyes and slurred speech, according to court records.

A test for breath alcohol content returned a result of .249.

During processing at the Perry Police Department, Rodriguez allegedly kicked and struck an officer.

Rodriguez was held in the Dallas County Jail on a $2,000 cash or surety bond. She is scheduled for a preliminary hearing Dec. 26 in Dallas County District Court.

Rodriguez was convicted of assault causing bodily injury or mental illness in 2021 in Dallas County District Court.
