Des Moines men face drug charges after bad turn at Jordan Creek

Two Des Moines men were arrested on drug charges Wednesday night near the Jordan Creek Town Center in West Des Moines after they allegedly turned left at a no-left-turn sign.

Herschel Thomas Davis, 69, of 1120 Geil Ave., Des Moines, was charged with controlled substance violation, tax stamp violation and driving while barred.

Anthony Ross Harvey, 36, of 1920 E. Walnut St., Des Moines, was charged with controlled substance violation, third or subsequent offense possession of a controlled substance, violation of a no-contact order and providing false identification information.

The incident began about 11 p.m. Wednesday at the Jordan Creek Parkway on ramp to U.S. Interstate 80, where an officer of the West Des Moines Police Department observed a 2012 Cadillac Escalade violate a no-left-turn sign and initiated a traffic stop.

Davis was allegedly found in possession of “18 oxycodone pills with the intent to deliver,” according to court records.

Harvey was allegedly found in possession of “a controlled substance consistent with methamphetamine” and “a controlled substance believed to be heroin of 5 grams or less,” according to court records.

Harvey also allegedly misidentified himself to law enforcement and was found to be in violation of a no-contact order with Davis.

Davis was held in the Dallas County Jail on a $10,000 cash or surety bond. He is scheduled for a preliminary hearing Oct. 10 in Dallas County District Court.

Davis was convicted of driving while barred in 2013, 2014, 2017, twice in 2018, 2021 and 2022 in Polk County District Court.

Harvey was convicted of possession of a controlled substance in 2004 in Polk County District Court. He was convicted of a controlled substance violation in 2009 in Polk County District Court. He was arrested on a charge of second-offense possession of a controlled substance in Des Moines in May 2022. The case is pending in Polk County District Court.

*A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
