Elkhart man arrested for allegedly punching Waukee woman

Gabriel James Hathaway, 46, of Elkhart was arrested Tuesday on a charge of first-offense domestic abuse assault-bodily injury or mental illness.

An Elkhart man was arrested Tuesday on a Dallas County warrant in connection with a November incident in Waukee in which he allegedly punched a woman in the face.

Gabriel James Hathaway, 46, of 1012 E. Walnut St., Elkhart, Iowa, was charged with first-offense domestic abuse assault-bodily injury or mental illness.

The incident occurred about 11:30 p.m. on Nov. 13, 2022, in the 500 block of S.E. Westgate Drive in Waukee, where officers of the Waukee Police Department responded to a report of a domestic disturbance.

The officers made contact with the victim, who told the officers “that her boyfriend punched her in the face,” according to court records.

The officers observed on the victim “blood on her hands and face, that came from her mouth,” as well as “blood on the front walkway leading to the house, blood on the front door and blood on” the victim’s “cell phone,” according to court records.

The victim told the officers that Hathaway also assaulted her on July 4, 2021, when he allegedly “hit her in the head twice, so hard that she threw up and possibly had a concussion,” according to court records. The victim did not call the police or seek medical assistance on the previous occasion.

Hathaway was held in the Dallas County Jail on a $1,000 cash or surety bond. He is scheduled for a preliminary hearing April 7 in Dallas County District Court.

Hathaway was convicted of domestic abuse assault in 2000 in Story County District Court. He was convicted of domestic abuse assault-bodily injury or mental illness in 2009 in Story County District Court. He was convicted of assault causing bodily injury or mental illness in 2019 in Polk County District Court.

*A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
