West Des Moines man arrested for fighting cops at Waukee motel

Burke Kristian M. Tuinstra, 39, of West Des Moines was arrested Wednesday on charges of assault on persons in certain occupations, four counts of interference with official acts-bodily injury, one count of interference with official acts, trespassing and first-offense possession of a controlled substance-marijuana.

A West Des Moines man was arrested Wednesday after allegedly fighting with officers of the Waukee Police Department who were trying to remove him from a Waukee motel at the request of the motel management.

Burke Kristian M. Tuinstra, 39, of 6440 E. P. True Parkway, West Des Moines, was charged with assault on persons in certain occupations, four counts of interference with official acts-bodily injury, one count of interference with official acts, trespassing and first-offense possession of a controlled substance-marijuana.

The incident began about 4:45 p.m. Wednesday at a motel in the 2800 bock of Grand Prairie Parkway in Waukee, where officers of the Waukee Police Department attempted to make contact with Tuinstra, who allegedly “had been sending threating emails to one of the
Waukee School District schools,” according to court records.

While the officers spoke with Tuinstra, workers at the hotel informed the officers they wanted Tuinstra “removed from the hotel,” according to court records. The officers repeatedly directed Tuinstra to vacate the hotel, but Tuinstra refused.

Eventually a physical altercation ensued in which officers sustained injuries to the right shin, the left elbow, the left forearm and the right elbow, according to court records

Once detained, Tuinstra was found to be in possession of “a ‘Batch’ THC vape pen with a yellow wax-like substance which is consistent with that of marijuana wax,” according to court records.

Tuinstra was held in the Dallas County Jail on a $7,000 cash or surety bond. He is scheduled for a preliminary hearing May 27 in Dallas County District Court.

Tuinstra was convicted of disorderly conduct in 2009 in Polk County District Court. He was convicted of disorderly conduct in 2014 in Polk County District Court. He was convicted of first-offense possession of a controlled substance in 2017 in Polk County District Court.

*A criminal charge is merely an accusation, the defendant is presumed innocent until and unless proven guilty.
