Perry man pistol whips officer while trying to flee

Kyle Patrick Lingner, 34, of Perry was arrested Wednesday on charges of interference with official acts-firearm, person ineligible to carry dangerous weapons, providing false identification information and as a fugitive from justice.

A Perry man was arrested early Wednesday after allegedly striking an officer of the Perry Police Department in the face with a firearm while attempting to run away.

Kyle Patrick Lingner, 34, of 1502 Estella St., Perry, was charged with interference with official acts-firearm, person ineligible to carry dangerous weapons, providing false identification information and as a fugitive from justice.

The incident occurred about 2 a.m. Wednesday in the 700 block of First Avenue, where  an officer of the Perry Police Department made contact with Lingner, who “proceeded to run away” from the officer, according to court records.

While running away, Lingner “face planted on the ground while reaching for something in his waistband,” according to court records.

The officer attempted to “restrain” Lingner and was “struck in the face” with “a metal object” that the officer “was able to identify” as “a firearm,” according to court records.

Once in custody, Lingner allegedly gave a false name, according to court records. It was eventually determined that he had active arrest warrants for second-offense OWI in Guthrie County, first-offense OWI in Dallas County and for an unspecified charge in Sarpy County, Nebraska.

Lingner is held in the Dallas County Jail on a $20,000 cash or surety bond. He is scheduled for an extradition hearing May 10 and a preliminary hearing May 17 in Dallas County District Court.

*A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
