Perry man with vicious dogs allegedly threatens neighbor with gun

A Perry man was arrested Saturday night after allegedly threatening his neighbor with a handgun in a dispute over their pets.

Aristeo Diaz, 39, of 1209 18th St., Perry, was charged with assault while displaying a dangerous weapon.

The incident began about 8:30 p.m. Saturday in the 1200 block of 18th Street, where officers of the Perry Police Department responded to a report of someone “attempting to point a firearm at” someone else.

The victim told the officers that Diaz’s “huskies were loose at the apartment property” when the victim “let his dog out,” according to court records. Diaz “walked up to the victim with his huskies, who attempted to bite at the victim’s dog.”

When the victim “kicked the huskies,” Diaz allegedly “reached inside his coat” and told the victim that “he was going to pop him if he did it again,” according to court records.

The victim told the officers that Diaz allegedly “reached into his coat pocket to aim the gun at him, in which he lost grip of the gun and dropped it on the ground,” according to court records.

Diaz is held in the Dallas County Jail on a $2,000 cash or surety bond. He is scheduled for a preliminary hearing March 22 in Dallas County District Court.

Diaz was issued a citation for first-offense dog at large in July 2020 after his two large dogs killed a small dog at the apartment house next to Diaz’ residence, also the location for Saturday’s incident.

Diaz was convicted of vicious dog in 2006 in Dallas County District Court. He was convicted of carrying weapons in 2009 in Dallas County District Court. He was convicted of assault while displaying a dangerous weapon in 2013 in Dallas County District Court. He was convicted of vicious dog in 2020 in Dallas County District Court. He was convicted of third-offense dog at large in 2021 in Dallas County District Court. He was convicted of fourth-offense dog at large in 2021 in Dallas County District Court. He was issued a citation Feb. 25 for fourth-offense dog at large.

*A criminal charge is merely an accusation, and the defendant is presumed innocent until and unless proven guilty.
