Adel man arrested for OWI after dozing in McDonald’s drive through

An Adel man was charged with drunk driving July 3 after he was found passed out in his vehicle in a McDonald’s drive through in West Des Moines.

Eric Robert Michelberger, 43, of 31625 R Ave., Adel, was charged with third or subsequent offense OWI.

The incident began shortly before 5 p.m. July 3 in the 1300 block of Jordan Creek Parkway, where officers of the West Des Moines Police Department responded to a request for “a welfare check of a male passed out behind the wheel while in a drive-through lane,” according to court records.

The officers made contact with Michelberger in his 2007 Chevrolet Silverado. He presented “bloodshot, watery eyes, slurred speech” and “the odor of alcohol,” according to court records.

Michelberger declined “to submit to standard field sobriety tests,” according to court records.

Michelberger is held in the Dallas County Jail on a $5,000 cash or surety bond. He is scheduled for a hearing July 16 in Dallas County District Court.

Michelberger was convicted of first-offense OWI in 2006 in Madison County District Court. He was convicted of second-offense OWI in 2017 in Boone County District Court. He was convicted of second-offense OWI in 2019 in Polk County District Court. He was convicted of third-offense OWI in 2019 in Polk County District Court.
