Blue Jay Market receives city approval for second building

A 2,640-square-foot building is planned for construction on the west side of the Blue Jay market.

 

Deepak Nayyar and Vaishali Nayyar, owners of the Blue Jay Market at 2810 Willis Ave. in Perry, got the go ahead Monday from the Perry City Council to build a new 2,640-square-foot building next to their current market.

The Perry Planning and Zoning Commission voted unanimously Oct. 11 to recommend the Nayyars’ plan to the Perry City Council for approval “with the conditions that utility companies sign off on reconfiguring the service lines on the property, that an access easement be created with the property to the north (owned by the same owner) before a certificate of occupancy be issued, and that a phase I environmental survey be conducted pending the recommendation of the DNR,” according to the meeting minutes.

The city council in turn approved the site plan this week with the recommended contingencies, one of which has already been satisfied.

Perry Community and Economic Development Director Daniel Van Holland told the council the site was formerly the location of underground storage tanks. Following a 1994 leak at the site, a three-year cleanup plan was executed, and the Iowa Department of Natural Resources now classifies the site as “no further action required,” Van Holland said.

“The threat appears to no longer be of concern,” he said in his report to the council.

Reconfiguration of one or more utility services — electricity, gas, water, telephone and sanitary sewer — might be needed around construction of the 44′ wide and 60′ deep building.

Parking stalls are planned on both the north and south sides of the new building, and an access easement across the lot to the north, which the Nayyars also own, was the council’s third contingency.

“Shared driveways and access easements are not uncommon,” Van Holland said, “however,
easements and agreements between the same party are less common. It is necessary to decide if we want to see documentation of these agreements before approval, issuance of a certificate of occupancy, or if ownership should change hands.”

Vaishali Nayyar said the new building would be used as “flex space” for other small businesses and for storage. She said that she is excited about the Perry expansion and also about their new store in Newton.
