Larry and Diana Carpenter of Perry, owners of Mid-Am Textiles at 809 Railroad St. in downtown Perry, abated their nuisance Tuesday by having a five-foot-wide swath cut from the concrete pad backing their property.

The concrete was removed as part of a compromise agreement the Carpenters reached with the city after it was found their concrete pad lay within the 20-foot right of way of the city-owned portion of the Raccoon River Valley Trail.

Larry Carpenter said he hired Harland Concrete of Perry to remove the five-foot edge from his driveway. The work cost $1,500, he said.

The Perry City Council is expected to formalize the agreement with Mid-Am Textiles at a future meeting.
